Professional Liability Insurance Program Exclusive to CAMRT Members


Aon Reed Stenhouse is pleased to be the assigned broker for the Canadian Association of Medical Radiation Technologists’ Professional Liability Insurance Program. Aon has been a leader in the Canadian insurance field for more than 150 years. ING Novex Insurance Company of Canada is the insurance company providing professional liability insurance to CAMRT members.

Who is an Insured

The Named Insured is a Full Practice, Limited Practice or Life Member of the Canadian Association of Medical Radiation Technologists who subscribes to this insurance contract provided a premium has been paid.

 
The Named Insured is also a former Full Practice, Limited Practice or Life Member of the Canadian Association of Medical Radiation Technologists who has taken temporary or permanent leave from employment related to practice of the profession in Canada and who subscribed to this insurance contract prior to the commencement date of leave, but solely for claims arising out of errors, omissions or negligent acts in rendering of Professional Services prior to the commencement date of any leave.

 Professional Services

“Professional Services” means those professional services rendered by the “Insured” while either:

    a)      practicing the profession of medical radiation technology within the scope of practice of the Insured as defined by the regulatory authority for the profession in the province in which the Insured practices or, in the absence of a regulatory authority, the CAMRT; or
    b)      engaged within a position responsible for the practice of others of the profession of medical radiation technology or directly related to the practice of medical radiation technology; or
    c)      performing ultrasound provided the Insured:
    i)           is registered with the Canadian Association of Registered Diagnostic Ultrasound Professionals (CARDUP) or the American Registry for Diagnostic Medical Sonography (ARDMS) and practicing within the scope of practice of their earned sonography credential (proof of registration required); or
    ii)         has successfully completed the necessary training in the relevant discipline of ultrasound and has been recognized by their regulatory authority where such regulatory authority exists; or
    iii)       has successfully completed a continuing education program in ultrasound offered by the Ordre des technologues en imagerie médicale et en radio-oncologie du Québec in the relevant discipline of ultrasound, and has provided a letter from their employer attesting to their competence.

Coverage is on a "claims made" basis, which means that the policy must be in place at the time a claim is reported. If an incident occurs that may give rise to a claim, it is imperative that you report it to Aon at 1-800-267-6262 ext. 280 immediately.

Special note: Although the CAMRT professional liability insurance coverage is written on a "claims made" policy form, members do not need to purchase insurance coverage if they are on a permanent or temporary leave from practice of the profession (eg. paternal, maternity, disability leave, unemployment etc).  In these circumstances the policy provides automatic coverage for claims arising out of errors, omissions or negligent acts in rendering of professional services prior to the commencement date of any employment leave. It is imperative to note however that members must reinstate the professional liability insurance coverage prior to returning to practice regardless of the circumstance (full time, part-time, casual or a one-time shift) and date. Please notify the CAMRT, through your provincial association, if you are taking a leave from employment in the practice of the profession. Should you wish to maintain your involvement in the association as a member while on leave, you may purchase a non-practicing membership during your leave period.

CAMRT members who wish to have coverage while practicing ultrasonography in the areas in which they are registered must present to the CAMRT Office written evidence of holding the RDMS designation. Francophone members who complete the OTIMRO Continuing Education courses in ultrasound, pass the examinations and have a letter from their employer attesting to their competence, may apply to CAMRT for coverage.

Extensions

Criminal Defense Costs Reimbursement Coverage

The Insurer will provide reimbursement for defense costs incurred during a legal proceeding provided that (a) the criminal charge arises from your practice in Canada; (b) the proceedings must pertain to alleged misconduct while rendering professional services; and (c) you are found “not guilty” of the criminal charge.

  • Limits of Liability:
    • Per member, Per Claim: $125,000
    • Per Member, Annual Aggregate: $125,000
    • Deductible: Nil

Legal Expense Coverage

The insurer will provide reimbursement for expenses incurred to defend yourself in front of a disciplinary committee. Covers members for complaints including professional misconduct, sexual abuse or sexual harassment the provincial regulatory boards.

    • Per member, Per Claim: $50,000
    • Per Member, Annual Aggregate: $100,000
    • Deductible: Nil

Coroner's Hearings Coverage

  • Limits of Liability:
    • Per member, Per Claim: $50,000
    • Per Member, Annual Aggregate: $100,000
    • Deductible: Nil

Loss of Earnings

Covers all reasonable expenses incurred by you, at the insurer's request to assist in the investigation or defense of a claim including actual loss of earnings up to $500/day as a result of time off work.
